Penalties

Article 89

Without prejudice to any stricter penalty stipulated by the Penal Code or any other code, breaching this law shall be penalized with the penalties stated in the following articles.     

Article 90

Breach of every term stipulated in clause (c) from article 5, articles 7, 19, 54, 81, and clause 2 from article 82 shall be punished with a fine that should not be less than thirty pounds and not more than one hundred pounds.

Article 91

Breach of every term stipulated in article 9,18,39,48,51,52,53 and clause 1 from article 82 shall be punished with a fine that should not be less than fifty pounds and not more than two hundred pounds.

Article 92

Breach of article 8 by cutting trees and palm trees without obtaining a license from the Ministry of Irrigation shall be punished with paying a fine that should not be less than thirty pounds and more than two hundred pounds. Violation of clause 2 of the mentioned article by lack of planting or care shall be punished with paying a fine not less than twenty pounds and not more than two hundred pounds. The Ministry of Irrigation shall have the right to undertake the planting and care at the expenses of the violator.

Article 93

Violation of every term stipulated in articles 23,24,35,37,45,49,57,73,75 and clauses 3,4,5,6,7,8,9 from article 82 and the resolutions issued in accordance with article 60 shall be punished with a fine not less than fifty pounds and not more than three hundred pounds.

Article 94

Violation of article 38 shall be punished with a fine not less than 30 pounds and not more than one hundred pounds for a feddan or less.

Article 95

Violation of article 46 shall be punished with a fine not less than two hundred pounds and not more than one thousand pounds. Violation of article 47 shall be punished with a fine not less than fifty pounds and not more than two hundred pounds. Enforcement of the penalties because of violation of articles 46, 47 shall not infringe the right of the Ministry of Irrigation in restoring the original state at the expense of the violator.

Article 96

Violation of article 64 shall be punished with a fine not exceeding one thousand pounds whether the violator was the owner, the holder or the occupant. Violation of article 69 shall be punished with a fine not less than fifty pounds and not exceeding one hundred pounds. The Ministry of Irrigation shall have the right to annul the license or stop the work till the removal of the violation causes.

Article 97

The Irrigation or drainage engineers, for whom a decree is issued by the Minister of Justice in agreement with the Minister of Irrigation, shall be designated as investigation officers in relation to the crimes stipulated in this legislation and which occur within their areas of jurisdiction as well as engineers of the Egyptian Public Authority for Shore Protection in relation to the crimes stated in articles 86, 87 and 88 of this law.
 
Article 98

The competent Irrigation Engineer, upon occurrence of infraction on the irrigation and drainage utilities, shall have the right to charge whoever benefits from this infraction by restoring things to its original state in a date that he/she determines, otherwise he/she shall carry out that task at the violators' expenses. The violator shall be notified via a registered letter, or in case of emergency via a telegram sent by the competent police station. These procedures shall be written down in the violation record reported by the Irrigation Engineer.

If the violator did not restore things to its original state in the appointed time, the competent Irrigation General Director shall have the capacity to issue a decree for the administrative removal of the infringement, without breaching the penalties stated in this law. The violator shall be informed with the value of the costs of restoring things to its original state and shall be responsible for paying that value in a month from the date of notification, otherwise the Ministry of Irrigation shall levy them by way of administrative seizer.

Article 99

Violation of articles 86, 87 and 88 of this law shall be penalized by detention and paying a fine not exceeding ten thousand pounds. Sentencing by ceasing implementation of the penalty of fine shall not be allowed. In all cases and without waiting for the verdict, the violations shall be ceased by the administrative way at the expense of the violator, the machines and devices used in the violation shall be held and confiscated in case of conviction.     

Article 100

Without prejudice to the penalties stated in this law, the violator of the license terms of irrigating new lands shall be bound to pay the compensation for the amount of water used in excess of the authorized amount, according to the rules set by the Minister of Irrigation.

This compensation shall be demanded via the administrative way.
